In the majority opinion of Obergefell vs. Hodges, Justice Anthony Kennedy ruled that same-sex couples could not be denied access to the “fundamental right” of marriage. Kennedy’s opinion stressed the central, unique, and even transcendent nature of marriage as a social bond within organized society, arguing that it represents “the highest ideals of love, fidelity, devotion, sacrifice, and family,” and is “essential to our most profound hopes and aspirations.”
